Definitions
Whenever we say "we", "us", "our" we are referring to The Good Water Company Limited and our staff. Whenever we say "you", "your", "you're" we're talking about you, our customer. When we refer to our website we're meaning www.goodwater.org.nz and when we say "Good water" we are meaning any of our products.

Whenever we say "One time only" we are referring to those customers that have selected a one time only delivery. Whenever we say "on-going" we are referring to those customers that have selected weekly, fortnightly or monthly deliveries. Whenever we say "12 month subscription customers" we are referring to those customers that have selected a 12 month subscription.

Privacy
By using our website to order your Good Water you are giving us permission to collect, use and disclose your information. We don't receive and hold your credit card details. Instead we use Direct Payment Solutions Limited ("DPS") to receive and process your credit card payments. DPS hosts and manages the payment page, which is secured by its own SSL certificate. Your credit card details are stored by DPS and only transmitted to the appropriate credit card agency for processing.

Under the Privacy Act 1993, you have the right to ask to see the information we hold about you. And if you notice that any of your details are incorrect just ask us to correct those for you.

Delivery
We will endeavor to deliver Good Water to you within 7 days. We shall not be liable for failure to deliver on a timely basis whether the delay has been due to causes beyond our control or otherwise. Delivery is for Monday-Friday only. Delivery prices are on a per delivery basis. Sorry we do not deliver to Private Bag or PO Box addresses.

You may include special delivery instructions with the order. If you're not available to sign for the delivery you can authorize the courier to leave the products in a specified location. This instruction gives the courier driver permission to leave the delivery without obtaining your signature, however if you choose to do this we hold no liability for products once they have been dispatched from our premises.

If you have not provided us with sufficient delivery instructions including but not limited to - lack of street number, spelling errors or rural delivery directions, we will hold no liability for the delivery of your purchase. Good Water will only be delivered within New Zealand.

Availability of Products
It is our intention that stock will be kept at a level that ensures all orders are fulfilled promptly. However, if for some reason a product is not available, we will notify you of this on our website.

Address Changes
Provided we are given 4 days notice you can change your address if you move house or office. We can accept short term delivery changes on a case by case basis.

Suspension
On going subscription customers may suspend their subscription at any time for up to 3 months. When your subscription is suspended, we will not deliver Good Water to you and we will not charge your credit card.
No credits will be applied for suspended days within the notice period.
For all suspensions, please apply via email.

Subscription Terms and Cancellations
If you are a 12 month subscription customer then you agree to receive regular deliveries for 12 months. With this, you authorise us to charge the product and delivery costs to your Credit Card before each delivery is dispatched. The minimum monthly amount is one case per month. Unless you advise us at least four days before the end of the 12 month subscription that you do not wish to continue receiving Good Water, your subscription will continue on an on going basis.

12 month subscription cancellation requests must be submitted in writing. If the subscription is cancelled before the expiration of the term you will be charged a $90.00 cancellation fee.

If you are an on-going subscription customer then you agree to have Good water delivered to you on on-going and regular basis as chosen by you on your initial purchase order. With this, you authorise us to charge the product and delivery costs to your Credit Card before each delivery is dispatched. On-going subscription orders will be dispatched and charged on the anniversary date of your initial order.

On-going subscriptions may be cancelled at any time by applying in writing. If the cancellation request is received at a minimum of four working days prior to your planned next delivery date you will not be penalized. If the cancellation request is received after four working days prior to your planned next delivery date then we reserve the right to charge you for those products and delivery costs.

If at the moment you only wish to purchase Good water one-time only then you are not bound by on-going subscription terms. Cancellation terms for one-time only orders are the same as those of the on-going subscriptions.

Confirmation of subscription cancellations will be emailed to your using the email address you supplied us.

Price and Payment
All prices charged to your Credit Card for Good Water are those as stated on our website at the time of the initial purchase order. Delivery costs are not included in the product price and will be an additional charge. All prices quoted are in New Zealand dollars and include GST.

You agree to pay us for the purchase of Good Water by authorising us to charge your Credit Card for the full price of the products and applicable delivery charges, on the date on which we dispatch the products.

Prices may be adjusted from time to time and we will notify you of these adjustments one month in advance of the date the adjustments are taking effect.

Site Content and Information
The information provided on the Good Water website is subject to change without notice. While every effort has been made to ensure accuracy, we will not be liable for any inaccuracies in the information contained herein.

All caution is taken in ensuring information on our website is correct when submitted and presented in good faith. We offer no warranty of accuracy or detail of information.

Refunds
If for any reason you are not happy with the Good Water you received please call us on (09) 970 3585.

We are not required to provide a refund if you change your mind about a particular purchase or would like to cancel your order outside of the cancellation terms, so please choose products carefully before ordering. A refund is at the discretion of our staff and is likely to incur a 10% fee of the original purchase price if processed. This fee covers the costs for accepting the credit card transaction, time in processing the order and in processing a refund transaction. We reserve the right to pass on return freight charges to you for returns and cancellations.

Electronic Messages Act 2007
You consent to further contact by email as defined by the Electronic Messages Act 2007.

Legal
This agreement is governed by the laws of New Zealand and the parties submit to the non-exclusive jurisdiction of the New Zealand courts in respect of all matters relating to this agreement.
